The judge who has prosecuted the defense of Real Madrid Raúl Asencio for child pornography and revelation of secrets has issued this Thursday a clarification of the processing order in which he clarifies that excludes the player from the recording crime of sexual videos that also attributed him at first. In the resolution, to which EFE has had access, the judge recognizes that “there is no indication that it will participate in the collection of the images and, therefore, it is not possible to attribute, not even provisionally, any participation in the possible crime” of revelation of secrets, as regards the recording of the videos. However, its processing is maintained for the crimes of revelation of secrets by exhibiting the video to a third person, and for child pornography for knowing that in the images a minor appeared.
In the order for which he ended the instruction of the case, the judge charged Asencio and his three former partners in the Real Madrid quarry (Juan Rodríguez, Ferrán Ruiz and Andrés García) The same three crimes: Revelation of secrets in the modality of recording videos, revelation of secrets for sharing intimate images without consent of the two young people affected and child pornography since one of the complainants is less.
A day later, the instructor has admitted that he made an error when relating Asencio to the recording of sexual images without the consent of those affected, since in the story of alleged facts he proposes to the parties it is appreciated that the Canarian defense remained outside the sexual encounter in which the images were recorded.
All this part of some events that happened on June 15, 2023 in a beach club of Amadores, in the south of Gran Canaria, when the four players, who were then 20 and 21 years old, met three girls with whom they spent part of the day. The processing car emphasizes that while everyone bathed in the pool and sunbathe together, one of the young women told the four defendants that he was 16 years old, so that everyone knew he was minor.
At one point, the youngest and another 18 -year -old girl agreed to go to a private cabin of the club with Ferrán Ruiz, Juan Rodríguez and Andrés García, with whom they maintained consented sex, while Raúl Asencio preferred to stay out and spend time with another girl in the general pool of the facilities.
One of them, allegedly Ferrán Ruiz, began to record the sexual scene without asking the girls and without them knowing that he was doing it; Then he passed the phone to Juan Rodríguez to continue doing it from another perspective, at which time the young women discovered what was happening although they were not clear if they had been recorded or not.
According to the judge, although they erased the videos recorded in front of the victims, the truth is that the recordings were shared by instant messaging, not only among specific people but also in collective dissemination groups, being stored in the mobiles of the recipients. Due to these facts, the judge underlines in the car, the child suffers “a post-traumatic stress disorder associated with the usual-depressive symptomatology”, which decreases its “personal, social and academic functional capacity”, while the other young woman also presents a picture of post-traumatic stress and anxious-depressive state.
